By filing this petition under Article 226 of the Constitution of India, petitioner seek quashing of order dated 31.12.2015 passed by the Foreigners Tribunal, Bongaigaon No. 2, Abhayapuri in BNGN/FT/Case No. 1432/2007 declaring the petitioner to be a foreigner who had illegally entered into India from the specified territory after 25.03.1971.

It is seen that on a reference made by the Superintendent of Police (B), Bongaigaon under the Foreigners (Tribunals) Order, 1964 with the allegation that petitioner was a foreigner who had illegally entered into India from Bangladesh after 25.03.1971, BNGN/FT/Case No. 1432/2007 was registered before the Foreigners Tribunal, Bongaigaon No.2, Abhayapuri (Tribunal).
4. Notice issued by the Tribunal was served upon the petitioner who thereafter entered appearance before the Tribunal and submitted written statement along with copies of certain documents disputing the allegation made and claiming to be an Indian citizen by birth. He also ad
