Petitioner in O.P.No. 7186 of 1991 is the appellant. appellant-petitioner is the Board of Directors of the Trivandrum District Co-operative Bank which is a Cooperative Society. For appointment of officers in the Bank, a notification was issued, evidenced by Ext. P2, inviting applications from eligible candidates. The selection was to be made by a written test which is followed by an interview. While the date for the test and interview was fixed, by Ext. P3 order dated 3-7-1991, the Joint Registrar stayed all further proceedings in respect of the appointment, pending an enquiry into a complaint regarding the process of selection. Later, by Ext. P5 order dated 6-7-91, Government also stayed further proceedings in the matter. The writ petition under Art.226 was filed by the appellant to quash Exts. P3 and P5. Petitioner contended that the order Ext. P3 by the Joint Registrar is beyond his power under the provisions of the Kerala Co-operative Societies Act, 1969 (for short, 'the act).
