JUDGMENT :

The petitioner Dental College is conducting Bachelor of Dental Surgery (for brevity, 'BDS') with an intake of 100 seats, as evident from Ext.P2 communication dated 31.07.2017 issued by the Government of India, Ministry of Health and Family Welfare, the additional 3rd respondent, and Master of Dental Surgery (for brevity, 'MDS') in 8 specialties with an intake of 3 seats each, as evident from Ext.P3 notification dated 14.07.2017 issued by the said respondent, on the strength of recognition granted by the 2nd respondent Dental Council of India and affiliation granted by the 1st respondent Kerala University of Health and Sciences. The petitioner has filed this writ petition, under Article 226 of the Constitution of India, seeking a writ of mandamus commanding the 1st respondent University to consider Ext.P10 application dated 18.09.2020 made by the petitioner and grant consent of affiliation, within a time limit to be fixed by this Court. The request made in Ext.P10 is to grant consent of affiliation for enhancement of intake in 5 MDS specialties, for the academic year 2
