Judgment

V.K. Bali, J.-This appeal under Section 18 of the Rajasthan High Court Ordinance, 1949 has been filed against the order passed by the learned Company Judge dated 30.07.2004 recorded in S.B. Company Application No. 112/2001 in S.B. Company Petition No. 30/1996 vide which the application of the appellant herein seeking employment in any of the departments of the State Government or in the public undertaking was dismissed.

2. The undisputed facts of the case reveal that the appellant was an employee of the Rajasthan State Agro Industries Corporation Limited which was ordered to be wound up by the Court but the winding up order had not been given effect to.

3. It has been urged by the learned Counsel for the appellant that on the company being wound up all employees of the company were being absorbed by giving them alternative employment and it is this request which was made before the learned Company Judge by moving an application but the learned Company Judge observed that during the course of hearing it has transpired that the appellant had filed writ petition challenging his deputation to the Rajasthan State Road Transport Corporation.
