RAJASTHAN HIGH COURT AT JAIPUR BENCH
G.C.Mital, P.K.Palli, JJ.
Dwarka Prasad Gupta - Appellant
Versus
State of Rajasthan & ors. - Respondent
D.B. Civil Special Appeal No. 6 of 1986.
Decided On : 2-12-1994
The Government has the power to amend rules, from time to time, and unless the rules are shown to be arbitrary, the court will have no jurisdiction to quash them.
Headnote:
RENT RECOVERY - RAJASTHAN CIVIL SERVICES (DETERMINATION AND RECOVERY OF RENT OF RESIDENTIAL ACCOMMODATION) RULES, 1958 - RULE 18(2) - AMENDMENTS - VALIDITY - STANDARD RENT - APPLICABILITY - RULE 11 - INTERPRETATION.
Fact of the Case:
The appellant, an LDC with the State Government, was allotted a Government house in 1970. In 1978 and 1983, the Rajasthan Civil Services (Determination and Recovery of Rent of Residential Accommodation) Rules, 1958 (the Rules of 1958) were amended to provide for the charging of rent from allottees of Government houses on the basis of a percentage of their pay scale. The appellant challenged the validity of the amended Rules, arguing that they were arbitrary and that Rule 11 of the Rules of 1958, which provided for the fixation of standard rent, should be applicable.
Finding of the Court:
The Court held that the amendments to the Rules of 1958 were not invalid and that the percentage of salary ranging from 3% to 81/2% of the salary was not arbitrary. The Court also held that Rule 11 of the Rules of 1958 was not applicable to the case because the amended Rules did not provide for the charging of rent on the basis of standard rent.
Issues: 1. Whether the amendments to the Rules of 1958 were valid? 2. Whether Rule 11 of the Rules of 1958 was applicable to the case.
Ratio Decidendi: 1. The Government has the power to amend rules, from time to time, and unless the rules are shown to be arbitrary, the court will have no jurisdiction to quash them. 2. Rule 11 of the Rules of 1958 will become applicable only if a rule like rule 18 provides for charging rent on the basis of standard rent.
Final Decision: The Court dismissed the appeal.
