JUDGMENT

1. - The attention is drawn to order passed in Criminal Misc. Bail No. 308/87 Raju v. State of Rajasthan , where the bail application of Raju was granted by Hon'ble G.K. Sharma, J. in a case where 280 gms. smake was found in the possession of Raju accused. In the instant case smake less then one gram has been recovered, the value of which does not exceed Rs. 20/-. In these circumstances I am inclined to accept this application particularly because Section 50 has not been complied with or the N. D. P. S. Act has nit been followed.

2. It is, therefore directed that accused petitioner Imamuddin be released on bail provided he furnishes a personal bond in the sum of Rs. 10,000/- ( Rs. ten thousand only) with two sureties in the amount of Rs. 5,000/- each to the satisfaction of the trial court with the stipulation to appear in that court as and when called upon to do so during the pendency of the trial against him in this case.Bail granted.
