JUDGMENT

1. 1. Both these revision petitions are disposed of by this single order because the questions involved in both of them are ideniical and are concerning the disposal of the petitions filed by the petitioner in the Court of District Judge, Jaipur City, Jaipur under Sections 2(3), 31, 32, 33 of the Arbitration Act, 1940, praying that the arbitrator may be restrained from proceeding with the arbitration in each case as there exists no arbitrable dispute.

2. In S.B. Civil Revision Petition No. 233/85 the Rajasthan State Electricity Board, petitioners invited tenders for supply of ACSR 'Panther' conductors. Respondent No. 1 on or about March 10, 1979, submitted tenders for manufacture and supply of 1000 kms. ACSR 'Panther' conductors valued at rupees one crore forty one lacs thirty thousand The petitioner placed the purchase order with respondent No 1 on or about November 2, 1979. On September 10, 1980, a formal contract in writing was executed between the petitioners and respondent No. 1. the relevant terms of the same are mentioned in para No. 5 of the petition filed before the learned District Judge, Jaipur City, Jaipur.
