JUDGMENT

1. This special appeal has been preferred by Ghewar Chand against the judgment dated 16.2.2009 passed by the learned Single Judge, whereby the, writ petition filed against the order of civil court rejecting application of the appellant filed under Order 7, Rule 14 CPC was dismissed.

2. According to the recent judgment passed by the Division Bench of this Court, the special appeal filed against the judgment passed in writ petition filed under Article 227 of the Constitution of India, challenging the order passed by the Civil Judge would not be maintainable. Therefore, this appeal is liable to be dismissed.

3. Accordingly, this special appeal stands dismissed, as not maintainable.Special Appeal Dismissed.
