1. 1. The petitioner is a prisoner serving sentence at Central Jail, Jaipur and from the record it appears that he has already served the sentence of 13 years and 9 months approximately. A prisoner, in our opinion, does not shed his basic constitutional rights at the prison gate. In he back drop of humanistic proposition that conviction of crime does not render one a non-person whose rights are subject to the whim of the prison administration, we proceed to decide the instant application.

It is contended in the application that the petitioner has been transferred from Central Jail, Jaipur to Central Jail, Jodhpur and this transfer is causing undue hardships to the family fox of the petitioner as he is native of District Baran and Jodhpur is very far from Baran. The petitioner made request to keep him at Jaipur, but it was not acceded.

3. The prayer of the petitioner in the instant writ petition is that a direction be issued to the respondents to repatriate the petitioner to Central Jail, Jaipur forthwith.
