JUDGMENT

1. - By the instant writ petition, petitioners seek setting-aside the impugned order dated 3.10.2001 (Annx. 8) passed by the Rajasthan Civil Services Appellate Tribunal (for short, "the Tribunal"), by which the petitioners were directed to grant selection scale to the respondent No. 1 from the date of his initial appointment.

2. The facts of the case are that respondent No. 1 was appointed on the post of Lower Division Clerk on 6.11.1981 on ad-hoc basis and passed the performance test on 17.8.85. He. was granted the first selection grade with effect from 18.2.93. Vide order dated 27.11.97 (Annx. 4), the date of 113 grant of first selection scale was changed as 17.8.94 instead of 18.2.93. Petitioner challenged the order Annx. 4 before the Tribunal by way of filing an appeal, which has been allowed vide impugned order Annx. 8 dated 3.10.2001. Hence this writ petition.

3. I have heard learned counsel for the parties and perused the record.
