JUDGMENT

1. - The petitioner has challenged the order dated 28.2.2011, issued by the Superintendent of Police, District Banswara, whereby the Superintendent of Police has directed for reopening of the history-sheet of the petitioner and for putting him under surveillance.

2. It is the case of the petitioner that he is a member of the Panchayat Samiti Bagidaura, District and doing business as a property dealer. Till 2006, certain cases were registered against him, which are still pending before the trial Court. However, since 2006, no case has ever been registered against him. On 3.3.2010, the D.I.G. had written to the Deputy S.P. Kushalgarh, enquiring as to the current status of the activities of the petitioner. The D.I.G. also sought information whether any new case was registered against the petitioner post- 2006. The DIG was informed that no case was registered against the petitioner after 2006. Therefore, vide order dated 8.4.2010, the D.I.G. had directed that history-sheet against the petitioner should be closed. But despite the order of the D.I.G., vide order dated 28.2.2011, the S.P. directed the S.H.O., Police Station, Sallopat, to reopen the history-sheet and to put the pet
