Headnote:Criminal Procedure Code, 1973 – S. 482 Challenge has been made to order of Standing warrant of arrest issued against the Petitioner for further questioning by CBI – Thus, petitioner directed to appear before C.B.I. on 5.3.2012 as assured by the Counsel – no objection by State – Held, meanwhile arrest warrant shall not be executed

JUDGMENT

1. - The petitioner has challenged the order dated 23.12.2011 passed by the Additional Chief Judicial Magistrate (CBI Cases) Jodhpur, whereby the learned Magistrate has issued standing warrants of arrest against the petitioner for her further questioning by the CBI.

2. Heard Mr. M.K. Garg, the learned counsel for the petitioner and Mr. Panney Singh, the learned Spl. Public Prosecutor for CBI.

3. Mr. M.K. Garg, the learned counsel for the petitioner, assures this Court that Smt. Indira Bishnoi shall appear before the CBI for further questioning on 5th March, 2012. Therefore, he prays that this Court may direct that the warrant of arrest shall not be executed against her.

4. The learned Special Public Prosecutor has no objection.

5. Therefore, this Court directs the petitioner to appear before the CBI on 5th March, 2012 at 10:30 AM. Meanwhile the arrest warrant issued against the petitioner shall not be executed.

6. With these observations, the petition is, hereby, disposed off.Petition disposed of.
