Criminal Procedure Code, 1973, Section 439 -the petitioner faces charges for offence u/s 147, 341, 148, 149, 323 and 307 IPC sought for bail-it was alleged that the petitioner inflicted sword blow to the injured, but there was no such injury as inflicted by sharp weapon-the injuries were simple in nature-accordingly the case was fit to grant bail to the petitioner and application considered.

JUDGMENT

1. - This bail application u/s. 439 Cr.P.C. has been filed on behalf of the petitioner-Shakti Singh against whom investigation is pending for the offences u/ss. 147, 341, 148, 149, 323 & 307 IPC in FIR No. 212/2003, Police Station Galtha Gate, Jaipur wherein the allegation against the petitioner is that he inflicted sword blow on the petitioner, but there is no sharp-edged injury on his person and the injuries found on the person of Satish Sahu are reported to be simple in nature.

2. Having considered the submissions made at the bar and after perusal of the police papers made available and taking into consideration all the facts and circumstances of the case, I deem it just and proper to enlarge the petitioner on bail.

3. In the result, this bail application is allowed and it is directed that petitioner-Shakti Singh S/o Shri Mukand Singh shall be released on bail on his furnishing a personal bond in the sum of Rs. 20,000/- together with one surety in the like amount to the satisfaction of the trial Court for his appearance before that Court on each and every date of hearing until conclusion of trial.Bail application allowed.
