Apprehension about threat must be founded on specific facts and not mere conjectures and surmises.

1. - By this petition, the petitioners have sought a direction against the respondent Nos. 1 to 4 to provide them appropriate and adequate protection to save their life and limb and a further direction is sought against respondent No. 5 not to interfere in their matrimonial life by way of undue threat or any overt act.

For claiming the aforementioned reliefs, the petitioners have, inter alia, averred in the petition that they are legally married and the marriage was solemnized on 11th June, 2013 at Arya Samaj, Golnadi, Ummed Chowk, Jodhpur and at the time of marriage, both the spouse were major. The precise allegation of the petitioners is that their parents and the society are not happy with their liaison and there is every likelihood that they may cause harm to them and disturb their matrimonial life.

3. The allegations pertaining to the imminent threat to life and limb of the petitioners are absolutely vague, cryptic and unspecific. There is no specific incident quoted in the petition indicating that the fifth respondent has threatened them or has acted unlawfully to create any sort of hindrance in their matrimonial life. True it is that the Hon'ble Apex Court in the case of Lata Singh v. State of U.P. & Anr., 2006(2) WLC (SC) Cri. 172 : 2006 Cr.L.J. 3312 has issued requisite directions in the matter of inter-caste marriage to extend protection to the couple, but the so-called apprehension about threat has to be founded on specific facts and not on the basis of mere conjectures and surmises as is depicted in the instant case.

4. In this view of the matter, I am not inclined to interfere in the matter at this stage. Consequently, there is no merit in this petition and same is accordingly dismissed.

5. It is made clear that the dismissal of this petition shall not preclude the petitioner-couple from seeking protection from the police authorities and administration in the event of any imminent threat to their life and limb in future.Petition Dismissed.
