JUDGMENT

1. - The challan against the petitioner was for the offence under Section 307 IPC and the charge framed against him is under Section 326 IPC. The case is triable by the Magistrate. I have looked into the injury report. Though the injured Narendra has received as many as 20 injuries but only two of them are grievous, which are fractures of little fingers. The size of the injuries is also not very big. So as to deny the benefit of bail to the accused petitioner. He has remained in custody for about four months, be can be released on bail on appropriate conditions.

2. The accused Vijay Joshi shall be released on bail provided he furnishes a bail bond in the amount of Rs. 5000/- with one surety in the like amount to the satisfaction of the Sessions Judge, Bundi for his appearance during the court of trial on all dates of hearing and as and when he is called upon to do so and also on the following conditions :

(a) he shall not carry any weapon with him.

(b) he shall not commit any offence, and

(c) he shall not threaten or influence the witnesses for the prosecution.
Bail granted.
