JUDGMENT

1. - The instant appeal has been filed on behalf of the appellant - Suresh Kumar challenging the judgment dated 21.7.2008 passed by lie learned Addl. Sessions Judge (Fast Track), No. 3, Udaipur Camp Salumber, Distt. Udaipur in Sessions Case No. 90/2007, whereby the appellant was convicted and sentenced as under:-

OFFENCE

SENTENCE

Under Section 307 I.P.C.

Ten year' R.1. and to pay a fine of L 1000/- and in default of payment of fine to further undergo three months' S.I.

Under Section 326 I.P.C.

Seven years' R.1. and to pay a fine of L 500 and in default of payment of fine to further undergo one month's S.I.

Under Section 324 I.P.C.

One year's S.I. and to pay a fine of L 500 and in default of payment of fine to further undergo one month's S.I.


2. Briefly stated the facts necessary for the disposal of this appeal are that in this case, the appellant has been convicted for assaulting his wife Smt. Priyanka over a minor exchange of hot talks. When the appellant aimed a sword blow on the head of Smt. Priyanka, she raised her hands in order to save herself. Due to the sword blow, the injured received injuries on he
