A suit for injunction is maintainable even if the plaintiff does not seek relief for possession, provided that the plaintiff can establish a valid title to the property in question.

Fact of the Case:

Plaintiff-respondent Moda filed a suit for possession and injunction against the defendants-appellants Gopal Lal and Bhagwan Lal, claiming title to a talia measuring 20 feet x 40 feet situated in Village Salawatiya, Tehsil Mandalgarh, District Bhilwara. The plaintiff-respondent relied on a patta issued in favor of Nanda Das, which was subsequently transferred to him by a registered sale deed. The defendants-appellants claimed that the suit property was transferred to them by Nandalal and Ambalal, but they could not produce the original sale deeds. The trial court and the appellate court decreed the suit in favor of the plaintiff-respondent.

Finding of the Court:

The High Court held that the learned courts below did not err in granting the decree of possession as well as injunction against the defendants-appellants. The court noted that the defendants-appellants had failed to produce a valid sale deed in their favor, and that the patta issued in favor of Nanda Das, which was subsequently transferred to the plaintiff-respondent, was valid. The court also held that the suit for injunction was maintainable even though the plaintiff-respondent had not sought relief for possession.

Issues: 1. Whether the learned lower courts were right in relying on a subsequently created document Ex.1 Patta as a valid deed conferring title on the plaintiff? 2. Whether in view of the contention of the plaintiff that he has been dispossessed on 7/1/77, a suit for mere injunction without seeking the relief for possession, is not maintainable and, therefore, the learned lower Courts erred in granting the decree in favour of the plaintiff?

Ratio Decidendi: 1. The court held that the patta issued in favor of Nanda Das was validly issued and by a registered sale deed, he had transferred the same in favor of the plaintiffs, and therefore, the decree of possession as well as injunction against the defendants-appellants, had been rightly granted by the learned courts below in favor of the plaintiffs-respondents. 2. The court held that the suit for injunction was maintainable even though the plaintiff-respondent had not sought relief for possession, as the defendants-appellants had failed to produce a valid sale deed in their favor.

Final Decision: The High Court dismissed the second appeal filed by the defendants-appellants and upheld the decree of the lower courts in favor of the plaintiff-respondent.

JUDGMENT

1. (Oral) - The present second appeal under Section 100 CPC has been filed by the defendants-appellants-legal representatives of Late Shri Gopal Lal s/o Shri Rameshwar Lal and his brother, Bhagwan Lal, who is now represented by his legal representatives, against Shri Moda s/o Shri Dhanna Dhakad, against the decree of possession and injunction in favour of the plaintiffs-respondents concurrently given by the learned courts below.

2. The learned trial court of the Munsif & Judicial Magistrate, Bijolia by the order dated 05.05.1983 decreed Suit No.28/80 (4/77) - Moda v. Gopal Lal in favour of the plaintiff-respondent, with the following findings:-
