Motor Vehicles Act, - Section 147 - Accident - Claimants filed claim applications and claimed compensation - Learned counsel for appellants has contended that findings given by learned Tribunal on issue are legally not sustainable by this Court being contrary to provisions of law as well as facts of case - Counsel has further submitted that learned Tribunal has committed an error while not considering fact that vehicle was insured and a premium of Rs. 50/- for Khalasi and Rs. 25/- for driver was taken but learned tribunal has committed serious error while not considering fact that Rs. 100/- which was shown in cover note has not been explained that on what accused used Rs. 100/- was charged by insurance company – Held , Counsel has further submitted that learned Tribunal has further committed an error while not considering fact that in cover note in head of licence carrying capacity in which 3 has been mentioned but even then learned tribunal has not considered this important aspect of matter and only assessed that vehicle was insured only for two passengers and one driver, which is wrong and contrary to cover note produced before learned tribunal - Counsel has further submitted that learned tribunal has committed serious error while exonerating insurance company and amount awarded to claimants is on higher side - Counsel has further submitted, no liability can be fastened on owner of vehicle - Hence impugned award deserves to be modified/enhanced - learned counsel for respondents has opposed submissions advanced on behalf of appellants and requested for maintaining/setting aside of judgment and award and further submitted that on account of negligence of driver of vehicle, received grievous injuries and Died - Hence, owner of vehicle is liable to make payment of amount of compensation – Appeal dismissed

All the four civil misc appeals arise out of common Judgment and Award dated 7.4.2005 passed by the learned Judge, MACT, Baran in four different claim petitions, hence same are being decided by this common judgment.
