1. This civil misc. appeal under Section 19 of the Family Courts Act has been preferred against the order dated 16.12.2014 passed by the learned Judge, Family Court, Bhilwara in Civil Misc. Case No.299/2012, whereby the application under Section 13 of the Hindu Marriage Act, 1955 (hereinafter referred to as 'the Act') filed by the appellant was rejected.
2. Learned counsel for the appellant submits that the appellant has filed an application under Section 13 of the Act seeking divorce against his spouse on the ground of cruelty and desertion.
3. Learned counsel for the appellant stated that the marriage between both the parties was solemnized on 05.02.1993 and the respondent-wife continuously put pressure upon the appellant for separation from his parents. It was alleged by the wife that the husband was having illicit relationship. The counter allegation was also there, as the appellant had alleged illegitimate relationship of the respondent.
4. Learned counsel for the appellant also pointed out that a case was also lodged against him under Sections 498A and 323 IPC. Learned counsel for the appellant further pointed out that the learned court below
