Heard learned counsel for the parties on the application filed by the petitioners under Section 151 CPC for bringing on record legal representatives of petitioner No. 1 Ganesh Mal.
2. For the reasons mentioned in the application, the same is allowed. Legal representatives as indicated in the application are taken on record.
3. This revision petition is directed against order dated 07.03.1994 passed by Additional District Judge, Pali, whereby, the appeal filed by the petitioners against order dated 17.01.1994 has been modified.
4. After filing of the revision petition, provisions of Section 115 CPC stands amended and in view of the judgment of Hon'ble Supreme Court in Surya Dev Rai v. Ram Chandra Rai, (2003) 6 SCC 675 the present revision petition is not maintainable.
5. Besides the above, it may be noticed that the matter has remained pending before the Larger Bench for all these years, there is no interim order passed in the present revision petition and the modified order passed by the Appellate Court has remained in currency for now over 24 years.
