Present petition has been filed under Section 482 Cr.P.C. praying that the order dated 2.5.2016 passed by Metropolitan Magistrate No. 34, Jaipur Metropolitan, Chaksu, whereby application filed by the petitioner to send the cheque in question to Forensic Science Laboratory for handwriting examination has been rejected, be set aside. It is further prayed that the order 8.6.2017 passed by the revisional court below whereby order passed by the trial court was affirmed, be also set aside.
2. Learned counsel for the petitioner has submitted that one opportunity be granted to the petitioner to examine private handwriting expert in defence to prove that the cheque in question in no way bears signature of petitioner and contents of the cheque have not been filled by the petitioner.
3. Shri Prahlad Sharma, learned counsel for respondent No. 2, has submitted that one opportunity may be granted subject to condition that trial shall be concluded within the stipulated period.
4. I find merit in the submission advanced by the learned counsel for the parties.
