JUDGMENT

Manoj Kumar Garg, J. - Instant criminal appeal has been filed by the appellant under Section 374(2) Cr.P.C. against the judgment dated 29.03.2012 passed by learned Special Judge, NDPS Cases, Sriganganagar in Sessions Case No. 20/2010 by which the learned Judge convicted the appellant for offence under Section 8/15 NDPS Act and sentenced to undergo two years R.I. alongwith fine of Rs. 10,000/- in default of payment of fine to undergo six months R.I.

2. Brief facts of the case are that on 10.06.2010, the S.H.O. Police Station Ghamoorwali alongwith police party while on receiving a secret information, reached at a shop situated in Village 2 BB, Near Water Works. Upon search of the shop, the police found one plastic bag containing poppy husk for which the appellant had no license or permit. The police seized the contraband and arrested the appellant.

3. The police registered the FIR for offence under Section 8/15 NDPS Act and started investigation. After investigation, the police filed challan against the present appellant for offence under Section 8/15 of NDPS Act. Thereafter, the charges of the case were framed against the appellant. He denied the charges and claimed trial.
