JUDGMENT
Vijay Bishnoi, J. - Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record.
2. The petitioner has been arrested in FIR No.126/2016 of Police Station Borunda, District Jodhpur for the offences punishable under Sections 498-A, 302 and 306 IPC. He has preferred this criminal misc. interim bail application under Section 439 Cr.P.C. for releasing him on interim bail for thirteen days to attend the Twelfth Day Ceremony scheduled to be held on 17.09.2019 due to death of his father.
3. Learned counsel for the petitioner has submitted that as the father of the petitioner died on 06.09.2019 and his Twelfth Day Ceremony is scheduled to be held on 17.09.2019, the petitioner may kindly be enlarged on interim bail for one day i.e. 17.09.2019. It is submitted that the petitioner is ready to pay expenses of police guards to attend Twelfth Day Ceremony of his father.
4. Learned Public Prosecutor has opposed the bail application.
5. Having regard to the totality of the facts and circumstances of the case and in view of the above, without expressing any opinion on the merits of the case, I deem it just and proper to allow the petition
