JUDGMENT
1. With the consent of the learned counsel for the parties, the matter is heard finally.
2. The present appeal has been preferred against the judgment and award dated 20.09.2012 passed by the Motor Accident Claims Tribunal, Barmer in Claim Case No. 164/2009, whereby the learned Tribunal awarded a sum of Rs. 12,21,896/- as compensation to the claimants on account of the death of Champa Lal in the accident which occurred on 04.04.2009.Learned Tribunal after hearing the counsel for the parties decided the claim-petition of the claimants vide judgment and award dated 20.09.2012. Aggrieved of the order dated 20.09.2012, the present appeal has been preferred.
3. Learned counsel for the appellant submits that the learned Tribunal erred while computing the award in the present case as the salary of the deceased Champa Lal was Rs.23,434/- p.m. whereas, the learned Tribunal has taken only Rs.l3,693/-p.m. He, therefore, submits that the compensation amount has been awarded on a much lower side.
4. The next contention of the counsel for the appellant is that no amount on account of future prospects has been awarded in the light of the Judgment of Hon'ble the Supreme Court in the case of N
