TA/DA Rules, 1971 - Rule 17(1) - Civil Service - Petitioner vide order was transferred from Government Senior Secondary School to Government Senior Secondary School said order was challenged by petitioner before Tribunal by way of filing appeal and Tribunal was pleased to stay operation of transfer order - It is further submitted that after passing of the stay order petitioner joined again - During the pendency of stay order in Appeal petitioner vide transfer order was again transferred to the same place where he was transferred by way of earlier transfer order - Petitioner was relieved on the same day - Impugned transfer order was again challenged before Tribunal by way of filing the appeal - Tribunal vide order rejected the appeal without considering and appreciating of the case and legal position involved in the appeal - Held, Petitioner was again transferred to same place vide order - Petitioner challenged his second transfer order - Tribunal vide order dismissed appeal of petitioner and following observations were made in the impugned order - A perusal of impugned order of learned Tribunal makes position clear that earlier the transfer order of the petitioner was stayed by an interim order however it was clearly mentioned in earlier order of the learned Tribunal but the respondents were given liberty to pass order afresh after complying with the relevant rules (Travelling Allowances Rules, 1971) - Second transfer order passed by the respondents was held to be as per rules and as per the liberty granted by learned Tribunal in its earlier order - Writ petition is devoid of any merit and is liable to be dismissed - Writ Petition dismissed - Stay application also stands dismissed.

1. It has been submitted on behalf of petitioner that the petitioner vide order dated 30.09.2021 was transferred from Government Senior Secondary School, Bhandana to Government Senior Secondary School Jatwara, Dausa. The said order was challenged by the petitioner before the Tribunal by way of filing the appeal No. 4888/2021 and the learned Tribunal was pleased to stay the operation of transfer order dated 30.09.2021 on 26.10.2021, clearly giving finding that there has been violation of Rule 17(1) of the TA/DA Rules, 1971.
2. It is further submitted that after passing of the stay order, the petitioner joined again at Bhandana. During the pendency of stay order in Appeal No. 4888/2021, the petitioner vide transfer order dated 07.01.2022 was again transferred to the same place where he was transferred by way of earlier transfer order dated 30.09.2021. The petitioner was relieved on the same day (07.01.2022). The impugned transfer order dated 07.01.2022 was again challenged before the Tribunal by way of filing the appeal No. 86/2022. The learned Tribunal vide order dated 18.01.2022 rejected the appeal without considering and appreciating the facts and circumstances of the case and legal position involved in the appeal. Hence, this writ petition with following prayer:
(i) By an appropriate writ order or direction the impugned judgment dated 18.01.2022 (Annexure-1) passed by the Ld. Rajasthan Civil Service Appellate Tribunal, Jaipur in Appeal No. 86/2022 titled as Roopnarayan Kuldeep vs. State of Rajasthan and Others, may kindly be quashed and set aside.
(ii) By an appropriate writ order of direction the Appeal No. 86/2022 (Annexure-2) filed by the petitioner may kindly be allowed as prayed for thereby setting aside the transfer order dated 07.01.2022 and the relieving order dated 07.01.2022 (Annexure-1 and 2 of the Appeal).
(iii) Any other appropriate order, which may be found just and proper in the facts and circumstances of the case, be passed in favour of the petitioner.”
3. Heard learned counsel for the petitioner through video conferencing.

A perusal of the record reveals that the petitioner was initially transferred vide order dated 30.09.2021 from Government Senior Secondary School, Bhandana (Dausa) to Government Senior Secondary School Jatwara, Dausa. The petitioner preferred an appeal against this transfer order dated 30.09.2021 and the learned Tribunal vide order dated 26.10.2021 passed the order staying the operation of transfer order dated 30.09.2021 and following observation was made:
