Criminal Procedural Code, 1973 - Section 482 - POCSO Act, 2012 - Prevention of Children Atrocity Commission Act, 2005 – Savings of inherent powers of High court – Held, in view of settled preposition of law and in light of judgment passed by Coordinate Bench of this Court in (supra) and other cases, the impugned order to extent of passing structure against the petitioner is concerned, is hereby quashed and set aside with direction that no punitive action with regard to service career shall be taken against the petitioner for the aforesaid structure without an opportunity of being heard - Petition disposed of.

1. The instant criminal misc. petition has been filed by the petitioner under Section 482 Cr.P.C. against the order dated 17.08.2019 passed by the Court of Special Judge, POCSO Act, 2012 and Prevention of Children Atrocity Commission Act, 2005, Sawai Madhopur (for short 'the trial court') in Sessions Case No. 76/2018 (78/2017) [State of Rajasthan vs. Udai Singh] to the extent whereby the Investigating Officer (petitioner herein) has prayed to expunge the adverse remarks made in para Nos. 45 to 47 of the judgment passed by the trial court. Para Nos. 45 to 47 of the Judgment of the trial Court reads as under :-
