JUDGMENT :

1. The petitioner has approached this Court by way of this writ petition (PIL) with the following prayers:-

"i) by an appropriate writ, order or direction the respondents, encroachment made over the land in question bearing Khasra No.584/1058 Gair Mumkin School field and Khasra No. 1439/422 of Village Panchodi, Tehsil Khinvsar, District Nagaur de hors the clear provisions of law and the aforesaid principles of law drawn by the Hon'ble Apex Court may kindly be declared illegal, arbitrary, unjustified and unconstitutional being violative of Articles 14 and 21 of the Constitution of India.

ii) By an appropriate writ, order, or direction, the impugned inaction on the part of the respondents in not removing the alleged encroachment so made over the land Khasra No.584/1058 Gair Mumkin School field and Khasra No.1439/422 of Village Panchodi, Tehsil Khinvsar, District Nagaur deserves to be declared illegal, unjust and contrary to the provisions of law and is violative of Article 14 and 21 of the Constitution of India.

iii) By an appropriate writ, order or direction, the respondent State of Rajasthan and the District Collector, Nagaur to remove the alleged encroachments made over the
