N.M. KASLIWAL, J.—This civil miscellaneous appeal is directed against an order of the Additional District Judge, Bharatpur, dated 6th August, 1979, whereby the appellant Smt. Parwati Devi had been restrained through an interim injuction from contracting a marriage with any other person during the pendency of the proceedings under section 9 of the Hindu Marriage Act, 1955, for restitution of conjugal rights.

2. The respondent Harbindra Singh filed a petition under section 9 of the Hindu Marriage Act, 1955, (hereinafter referred to as the Act) for restitution of conjugal rights against the appellant Smt. Parwati Devi. According to the husband Harbindra Singh, the marriage was solemnised between the parties on 29th July, 1978 at Bharatpur and the same was registered on 24th August, 1978, by the Registrar of Marriages Smt. Parwati Devi wife of the respondent refused to perform Marital obligations without any reason under the influence of her parents and as such a petition was filed under section 9 of the Act for restitution of conjugal rights. Smt. Parwati. appellant, contested the above petition inter alia on the ground that no marriage was soleminsed between the parties and she was no
