Honble MADAN, J.–The abovenoted revision petition is directed against the order dt. 26.4.1997 passed by the learned Civil Judge (Junior Division) Anta (Baran) in Co. No. 157/96 whereby the plaintiffs (respondents) application under Order 8 Rule 6 CPC was allowed excluding the counter claim filed by the petitioners/defendants.

The facts which are relevant for deciding this revision petition briefly stated are that on 10.4.95 the plaintiffs (hereinafter referred to as ``the respondents) filed a suit for permanent injunction against the defendants (hereinafter referred to ``as the petitioners) seeking the relief in the nature of permanent injunction to the following effect:-
