Honble GARG, J.–The abovementioned two appeals are being decided by this common judgment and order as both arise out of the same judgment and order dated 6.7.2002 passed by the learned Additional Sessions Judge (Fast Track), Udaipur as the accused appellant Dalpat has sent the appeal from jail also being appeal No. 760/2002 though he has filed representative appeal No. 665/2002.

FACTS OF APPEAL NO. 665/2002

(2). The accused appellants Dalpat Singh and Ratan Singh have preferred this appeal against the judgment and order dated 6.7.2002 passed by the learned Additional Sessions Judge (Fast Track), Udaipur in Sessions Case No. 150/2001 by which he convicted the accused appellants as under:-

Offence U/s. Sentence awarded

302/34 IPC Life Imprisonment and a fine of Rs. 1000 each, in default of payment of fine to further unergo 6 months R.I.

379/34 IPC 1 Years R.I.

Both the sentences were ordered to run concurrently.

(3). It arises in the following circumstances:

i) That on 12.9.2001 P.W. 2 Pritam Singh lodged a written report (Ex.P/4) with the police Station Sayra Dist. Udaipur stating that his brother P.W. 10 Jaswant Singhs wife Smt.
