Honble PANWAR, J.–This revision petition under Section 397/401 CrPC is directed against the judgment and order dated 14.1.2005 passed by Additional Sessions Judge, No. 1 Sri Ganganagar (for short `the appellant Court hereinafter) in Criminal Appeal No. 35/2004 whereby the appeal filed by the petitioner against the judgment and order dated 20.3.2004 passed by Additional Chief Judicial Magistrate, Sri Ganganagar (for short `the Trial Court hereinafter) in Criminal Case No. 794/2002 was dismissed and conviction and sentence awarded by the Trial Court was affirmed. During pendency of the revision petition, the complainant respondent Shakti Kumar appeared before this Court and filed a compromise compounding offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (for short `the Act hereinafter). The compromise has been verified by the Deputy Registrar, Judicial today. The complainant is present is the Court and admits composition of offence and seeks permission for composition of the offence.

(2). Section 147 of the Act provides that notwithstanding anything contained in the Code of Criminal Procedure, 1973, (2 of 1974), every offence punishable under this Act shall
