JUDGMENT

(Dev Darshan Sud, J.) - This is the wife’s petition against the judgment and decree of the learned learned District Judge, Mandi passed on the petition under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 (hereinafter referred to as the Act) filed by the husband praying for a decree for divorce on the ground of cruelty and desertion.

2. The undisputed facts are that the parties to this appeal were married according to Hindu rites on 30.6.1989. It is pleaded that they lived together harmoniously as husband and wife for six months, but the behaviour of the wife changed thereafter and she used to leave the matrimonial home without any justifiable cause and started threatening him that in case he objected, she would commit suicide and implicate him in false criminal cases etc.

3. The husband urges that in 1990, she left the matrimonial home without any justifiable cause and despite intervention by a number of respectable persons of the locality where the appellant was residing and repeated efforts by him, she did not relent from her behaviour and join his company.
