RSA No. 21 of 2003.
Decided on: July 21, 2014

Advocates Appeared:
For the appellant:Mr. Karan Singh Kanwar, Advocate.
For Respondents 1 to 3.:Mr. Virender Kumar Verma, Advocate

The central legal point established in the judgment is the legal entitlement of an illegitimate child to inherit the property of the deceased under Section 16 of the Hindu Marriage Act 1955.

Headnote:

Widow - Property Inheritance - Hindu Marriage Act 1955, Section 16 - The court affirmed the legal entitlement of the illegitimate child to inherit the property of the deceased under Section 16 of the Hindu Marriage Act 1955. The judgment was based on the proved facts and in consonance with the law.

Fact of the Case:

The case involved a dispute over the inheritance of the property of the deceased Khushal Singh. The plaintiff, Soma Devi, claimed to be the legally wedded wife of Khushal Singh and sought declaration and possession of the property for herself and her daughters. The defendants contested the claim, arguing that the plaintiff had no legal standing and that the suit was barred by limitation.

Finding of the Court:

The court found in favor of the plaintiff, affirming her status as the widow of Khushal Singh and the legal entitlement of her daughter, Santosh, to inherit the property under Section 16 of the Hindu Marriage Act 1955. The court also dismissed the defendants' arguments regarding the limitation and legal standing of the plaintiff.

Issues: The issues included the widow's status, the validity of a mutation, the entitlement to inherit the estate, the limitation of the suit, and the plaintiff's legal standing.

Ratio Decidendi: The court relied on the oral and documentary evidence, including marriage documents, family registers, and birth certificates, to establish the plaintiff's marital status and the legitimacy of her daughter's inheritance claim. The court also emphasized the legal obligation to protect the interest of the minor and cited relevant legal precedents to support its decision.

Final Decision: The court affirmed the judgment and decree passed by the lower courts, upholding the plaintiff's claim and dismissing the appeal filed by the defendants.
