2. Brief facts of case as pleaded are that Lekh Ram and others filed claim petition under Section 166 of Motor Vehicles Act 1988 pleaded therein that on 5.6.2006 deceased Smt. Shakuntla Devi was approaching to village Bharari to attend the marriage of her relative on scooter having registration No.HP-24-9045 along with her husband as a pillion rider and when scooter reached near PWD plant at Bhager truck No. HP-24-A-8525 came from back side in very rash and negligent manner which was driven by correspondent No. 2 and hit the scooter on back side due to which petitioner No.1 sustained grievous injuries on body and Shakuntla Devi died at the spot due to shock and haemorrhage.
