The petitioners have approached this Court for quashing of FIR No. 203 of 2013 registered at Police Station, West, Shimla on 9.10.2013 under Section 498-A IPC and consequential proceedings i.e. Criminal Case No. 39/2014 titled as State of Himachal Pradesh v. Gaurav Sharma and others pending before the Court of learned Additional Chief Judicial Magistrate 1st Class, Court No. 1, Shimla, H.P.
2. It is averred that the marriage between the petitioner No.1 and respondent No. 2 was solemnized at Shimla on 3.7.2009. It is further averred that with the passage of time the relations between petitioner No.1 and respondent No.2 got strained on account of their mutual differences and on account of incompatible temperament, the aforesaid FIR came to be registered against the petitioners by the respondent No.2.
3. Today, the petitioners and respondent No.2 are present in the Court and they are duly identified by their respective counsels. Learned counsel for the parties have stated that the parties have amicably settled the matter as per settlement deed dated 26.12.2014 annexed as Annexure P-6 with the case file.
