IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
Jyotsna Rewal Dua, J.
Sat Dev Singh - Petitioner
Versus
Himachal Pradesh Power Corporation Ltd and Ors. - Respondents
CWP No. 704 of 2025
Decided On : 14-07-2026
Important Points
Subject
Civil Law - Land Acquisition
Act Referred
Headnote
(B) Civil Procedure Code, 1908 - Order 2 Rule 2 - Constructive Res Judicata - Applicability to claims for enhancement based on contractual assurances versus statutory challenges. (Paras 3(i), 4)
Facts of the case:
Land was acquired by the respondents through negotiations based on a written assurance that enhanced rates would be paid to the petitioner in the future to ensure voluntary sellers were not disadvantaged. The petitioner previously obtained an order for enhanced compensation based on a specific land acquisition award. Subsequently, it was determined by the reference court and the High Court that compensation for lands acquired for the same project should be on a uniform basis irrespective of land classification. The petitioner sought further enhancement based on this uniform rate. The respondents opposed this on the grounds of constructive res judicata and Order 2 Rule 2 of the Civil Procedure Code, arguing that the petitioner had failed to challenge the original award under Section 18 of the Act.
Findings of Court:
The written assurance was intended to prevent voluntary sellers from being placed at a disadvantage. Since the compensation under the relevant award, which formed the basis of the petitioner's previous claim, was further enhanced to a uniform rate by the courts, the petitioner is entitled to this further enhancement. The failure to assail the statutory award under Section 18 does not estop the petitioner from seeking compensation under the negotiated agreement.
Issues: Whether the petitioner is barred by the principles of constructive res judicata and Order 2 Rule 2 of the Civil Procedure Code from seeking further enhancement of compensation based on subsequent judicial decisions regarding the same land acquisition award.
Ratio Decidendi: A contractual assurance to pay enhanced compensation based on a specific award extends to any further judicial enhancement of that award. Such a right is independent of the statutory remedy provided under the Land Acquisition Act; therefore, the omission to challenge the original award does not bar a claim for enhancement based on a binding undertaking. (Para 4)
Result: Writ petition allowed.

2. Petitioner not estopped because compensation under same award was later enhanced by court; respondent duty bound to inform. (Para 4 )
3. A landowner previously awarded enhanced compensation based on an award can claim further enhancement from later court orders; res judicata inapplicable. (Para 4 )
4. Writ allowed directing further enhanced compensation at uniform rate, but interest denied for period after earlier judgment. (Para 5 )
5. Does constructive res judicata bar a claim for further enhanced compensation based on later court orders when an earlier writ on the same award was already allowed?
No, because the later enhancement constitutes a subsequent event not in existence at the earlier petition, so res judicata does not apply. (Para 4 )
6. Does failure to file a reference under Section 18 of the Land Acquisition Act preclude a landowner from claiming enhanced compensation under a negotiated settlement with an assurance?
No, the land was acquired through negotiation and the assurance covers future enhancement, independent of whether the landowner challenged the collector's award. (Para 4 )
7. Is the acquiring body under a duty to inform the court about subsequent enhancements of compensation under the same land acquisition award?
Yes, as a party to all proceedings, it must disclose any enhancement of compensation under the same award to the court. (Para 4 )
JUDGMENT :
Jyotsna Rewal Dua, J.
The subject land belonging to the petitioner was acquired by the respondents under negotiated rates. In view of the written assurance/undertaking executed by the respondents at the time of negotiations to pay enhanced compensation to the petitioner in future, a writ petition instituted by the petitioner seeking enhanced compensation on the basis of Award No. 658 passed by the Land Acquisition Collector was allowed. The said decision has attained finality and has been implemented. Petitioner through instant writ petition seeks further enhancement in awarded compensation for the subject land on the ground that compensation awarded under Award No. 658 had undergone further enhancement in terms of orders passed by learned Reference Court as also by this Court. The respondent opposes this relief, taking plea of constrictive res judicata and provisions of Order 2 Rule 2 of Civil Procedure Code.
