1. Though the matter was duly listed in the regular cause list, but the parties have not chosen to appear either in person or through their counsels.

2. From the perusal of the file, it transpires that a revision came to be filed before this court way back on 28-11-1987 against the order dated 31-8-1987 passed by learned Sub-Judge, Baramulla in case titled Ghulam Mohammad Lone versus Ahad Wani, for setting aside the same.

3. In order to appreciate the matter in its correct perspective, a brief resume of the facts are required.

One person namely Abdullah War S/o Aziz War R/o Ushkara, Baramulla alienated a piece of land measuring 2kanals and 7marlas comprising of survey No. 2375 situated at Ushkara, Baramulla by virtue of a sale deed registered on 10-12-1986 in favour of Ahad Wani S/o Ramzan, Baramulla. Person of Jabbar War claiming to be the brother of Abdullah War was aggrieved of the said sale and on the basis of his right of prior purchase, filed a suit for possession on 8-8-1982. The suit was decreed on 31-3-1971 in favour of Jabbar War, decree holder with the direction that he shall make payment of consideration involved in the challenged sale deed besides the cost of stamp
