1. This judgement will dispose of Criminal Revision Petition No.25 of 1986 entitled Mohan Singh Vs. Puran Singh and Criminal Revision Petition No.43 of 1986 entitled Puran Singh Vs. Mohan Singh and ors.

Out of an incident which allegedly occurred on 8.8.1983 in the court premises at Jammu, two cross reports came to be lodged at Police Post, Panjtirthi, Jammu; one, by Mohan Singh petitioner in Crl. Revision No.25/86 and the other, by Puran Singh, petitioner in Crl Revision No.43/86. The report lodged by Puran Singh did not culminate in the registration of the case by the police and so he filed a complaint against Mohan Singh and other for offences under sections 307/323/324 R.P.C. The complaint was pending disposal in the court of City Magistrate. Jammu. The report lodged by Mohan Singh, on the other hand, culminated in the registration of a case and after investigation, police filed a challan under sec.307 R.P. C. against Puran Singh and others in the court of Munsiff Judical Magistrate 1st class, Jammu, on 26.10.1983, the learned Judicial Magistrate committed the case to the court of Sessions Judge, Jammu who transferred it for its disposal in accordance with law to the file of
