Present application has been filed seeking condonation of delay of 202 days’ delay in filing the appeal against the judgment of acquittal dated 27.08.2019.

1. The present application has been filed seeking leave to prefer an appeal against the judgment dated 27.08.2019 passed by the Principal Sessions Judge, Kathua (for short the trial court) by virtue of which the respondent has been acquitted of the charges in challan arising out of FIR No. 47 of 2014 of Police Station, Kathua for commission of offences under sections 8, 21 and 22 of the Narcotics Drugs Psychotropic Substances Act, 1985 (for short the NDPS Act).

2. Before appreciating the contentions of learned counsel for the applicant, it would be appropriate to give brief resume of the prosecution story as well as evidence of the prosecution witnesses.
