2. The petitioner is an accused in a case registered under Sections 406, 420, 467, 468, 471, and 120B of the I.P.C., pending in the court of Chief Judicial Magistrate, Dhanbad.

The prosecution case in brief is that the complainant (Chief Manager, Allahabad Bank, Park Market, Hirapur, Branch, Dhanbad) -the opposite party No.2 has filed a complaint case in the court of C.J.M., Dhanbad, alleging therein that the informant is presently the Chief Manager of Allahabad Bank, Park Market, Hirapur, Branch, Dhanbad and accused No.2 Shiv Dutta Mishra on 19th February 2004 took house loan of Rs.8,70,000/-from the said Branch in connivance with the petitioner.
