2013 Supreme(Jhk) 602
IN THE HIGH COURT OF JHARKHAND AT RANCHI
APARESH KUMAR SINGH, J.
Small Crusher Owners Association - Petitioner
Versus
Union of India and ors. - Respondents
WP(C) No. 1416 of 2013
Decided On : 7.5.2013
For the Petitioner: Mr. Rajiv Ranjan
For the Respondents: M/s. T.N. Mishra & Prabhash Kumar
The central legal point established in the judgment is that the requirement for obtaining a consent to operate certificate for mining operations of minor minerals under the Air Act, 1981 and Water Act, 1974 should be determined on an individual case basis.
Headnote:
Pollution Control Laws - Mining Operations - Air (Prevention and Control of Pollution) Act, 1981, Water (Prevention and Control of Pollution) Act, 1974 - Section 21, Section 25/26
Fact of the Case:
The petitioner, an association of small crushers owners engaged in mining operations of minor minerals, challenged the requirement to obtain a consent to operate certificate from the State Pollution Control Board. The Board relied on provisions of the Air Act, 1981 and Water Act, 1974, along with a letter from the Ministry of Environment and Forest, to support the requirement.
Finding of the Court:
The court found that the requirement to obtain a consent to operate certificate from the State Pollution Control Board for mining operations of minor minerals is a question of fact to be determined on an individual case basis. The court held that each individual lessee must approach the State Pollution Control Board to show that the provisions of the Acts are not applicable in their specific cases.
Issues: The issue raised by the petitioner association was whether the provisions of the Air Act, 1981 and Water Act, 1974 are applicable to obtain a consent to operate certificate for mining operations of minor minerals.
Ratio Decidendi: The court decided that the requirement for obtaining a consent to operate certificate from the State Pollution Control Board for mining operations of minor minerals should be determined on an individual case basis, and each lessee must approach the Board to show that the provisions of the Acts are not applicable in their specific cases.
Final Decision: The court disposed of the writ petition, stating that it is not convinced that there is no requirement for obtaining a consent to operate certificate by the members of the petitioner's association as lessees of minor minerals, and declined to interfere in the petition.
The petitioner is an association of small crushers owners, who also claim to carry on mining operation of minor minerals pursuant to lease granted to them. The petitioner is aggrieved as they have been asked to obtain consent to operate certificate in respect of mining operation from State Pollution Control Board though they are otherwise required to obtain environmental clearance. They have been asked to obtain consent to operate certificate on the basis of a letter of the State Pollution Control Board to the Commissioner of Mines, Government of Jharkhand made applicable to all such minor minerals lessees.
