This appeal is directed against the judgment of conviction dated 22nd September, 2001 and order of sentence dated 24th September, 2001 passed by 7th Additional Sessions Judge, Palamau at Daltonganj in Sessions Trial No.106 of 1985 holding the accused Sudama Thakur and Shiv Kumar Thakur guilty for the charges under Sections 367 and 370 of the Indian Penal Code and convicted for the same. Accused Pannalal Bind was found guilty under Sections 374 and 323 of the Indian Penal Code but he was acquitted of the charges under Section 367 of the Indian Penal Code. The convicts Sudama Thakur and Shiv Kumar Thakur were found guilty under Sections 367 and 370 of the Indian Penal Code but they were sentenced under Section 367 of the Indian Penal Code. No separate sentence under Section 370 of the Indian Penal Code was awarded as a result convicts Sudama Thakur and Shiv Kumar Thakur were sentenced to undergo rigorous imprisonment for seven years each whereas convict Pannalal Bind was sentenced to undergo rigorous imprisonment for six month each under Sections 374 and 323 of the Indian Penal Code.
