This interlocutory application has been preferred under Section 5 of the Limitation Act for condonation of delay of 28 days in preferring this Letters Patent Appeal.

2. Having heard learned counsels for both the sides and looking to the reasons stated in this interlocutory application, especially in paragraph Nos. 3, 4 and 5, there are reasonable reasons for condonation of delay. We therefore, condone the delay in preferring this Letters Patent Appeal.

3. Accordingly, LA. No. 6386 of 2017 is allowed and disposed of.

1. This Letters Patent Appeal has been preferred by the original petitioner whose writ petition being W.P.(S) No. 4422 of 2009 was dismissed by the learned Single Judge vide judgment and order dated 14.12.2016, whereby prayer for change of the date of birth from 29.11.1948 to 06.07.1954, was not accepted by the learned Single Judge, and hence, the original petitioner has preferred the present Letters Patent Appeal. The writ petition was preferred after one year of his retirement.
