JUDGMENT

Mr. Shree Chandrashekhar, J. – The petitioners, fourteen in numbers, have come to this Court challenging the educational qualification provided in the modified/ amended Advertisement No.21 of 2016, on the ground that requirement of having Graduation degree in "History and Political Science" with 45% marks in one of the two subjects for appointment to the post of Graduate-trained Teacher in History/Civics is contrary to the 2016 Rules. It is further contended that the educational qualification so provided for appointment of Graduate-trained Teachers is arbitrary and there is no nexus between the qualification and the object sought to be achieved, that is, appointment of teachers in the "subject".

Dr. Ashok Kumar Singh, the learned counsel for the respondent-Jharkhand Staff Selection Commission, however, submits that when the total number of subjects which are taught in a secondary school is seen with the total number of sanctioned posts, i.e., eleven, it would become clear that the subject-combination provided under the Advertisement is to provide a Teacher in the subject, i.e., "History and Civics" in a school.
