JUDGMENT
Shree Chandrashekhar, J. - The petitioners are aggrieved of the order dated 12.12.2007 by which cognizance of the offence under section 285, 304-A read with section 34 IPC and under section 72 of the Mines Act, 1952 has been taken.
2. Various grounds including the one founded on the decision in the State (NCT of Delhi) Vs. Sanjay" reported in , (2014) 9 SCC 772 have been raised by the petitioners to challenge the legality of the order taking cognizance, however, after arguing for some time seeking liberty for the petitioners to raise all such plea which are available to them in law, Mr. A. K. Das, the learned counsel for the petitioners seeks permission to withdraw this quash-petition.
3. This prayer is not opposed by Mr. Mukesh Kumar, the learned A.P.P.
4. In view of the limited prayer made on behalf of the petitioners, without commenting upon merits of the plea raised on behalf of the petitioners, Cr.M.P No. 1229 of 2017 stands withdrawn with liberty to the petitioners, as prayed for.
