JUDGMENT :

1. This appeal has been preferred by the appellant, Surendra Kumar Rai against the order dated 19.05.2017 passed by learned Chairman, Jharkhand Education Tribunal in Case No.27 of 2015 (JET).

2. Learned counsel Mr. Abhijit Kumar Singh, on the instruction of learned counsel for the appellant, Mr. Deen Bandhu, has assailed the impugned judgment passed by the learned Tribunal particularly finding no.1 that the Vidya Vikas Samiti, Jharkhand, Ranchi is the overall controlling and supervisory authority of the appellant and not Padmawati Jain Saraswati Shishu Vidya Mandir Sangathan, Chaibasa. The Vidya Vikas Samiti, Jharkhand, Ranchi is competent to transfer/depute the appellant and to take disciplinary action against him.

3. Learned counsel for the appellant has submitted that the above finding was given unnecessarily by the learned Tribunal though this part of the order is assailed on the ground that there is a title suit pending between the Management of the School before the Civil Judge Sr. Division, Chaibasa vide Title Suit No. 09 of 2018.
