Criminal Procedure Code,1973 – Section 482 –Saving of inherent power of high court - It has been vehemently argued on behalf of petitioner that FIR was lodged on being O.P. P.S. Case, lodged on and complaint was filed on alleging that petitioner not being I.O. in that case, for investigation of case has come to house of complainant on and tried to molest her - However, it has been argued on behalf of petitioner and O.P. that matter has been compromised. – Held, However, it has been argued on behalf of petitioner and O.P. that Court matter has been compromised - In view of allegations made, Court is not inclined to exercise powers under section 482 Cr.P.C. - dismissed.
JUDGMENT :
SANJAY KUMAR DWIVEDI, J.
1. Heard Mr. Indrajit Sinha, the learned counsel for the petitioner, Mr. Ashok Kumar, the learned counsel for the State and Mr. Vijayant Verma, the learned counsel for O.P. No. 2.
2. This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.
3. It has been vehemently argued on behalf of the petitioner that the FIR was lodged on 10.08.2016 being Katras (Angarpathara O.P.) P.S. Case No. 193 of 2016, lodged on 10.08.2016 and this complaint was filed on 09.08.2016 alleging that the petitioner not being the I.O. in that case, for investigation of the case has come to the house of the complainant on 10.08.2016 and tried to molest her.
4. However, it has been argued on behalf of the petitioner and the O.P. No. 2 that this matter has been compromised.
5. In view of the allegations made, this Court is not inclined to exercise powers under section 482 Cr.P.C.
6. Accordingly, the instant case is dismissed.
7. However, the petitioner, if so advised, may take all the grounds, etc. at appropriate stage.
8. I.A. if any, stands disposed of.
