RAJESH SHANKAR
Manti Devi – Appellant
Versus
State of Jharkhand – Respondent
ORDER :
1. The present writ petition has been filed for quashing order dated 12.01.2021 (Annexure-4 to the writ petition) passed by the respondent no. 2 the Deputy Commissioner, Chatra in PDS Shop Appeal No. 16/2016 as well as for setting aside the order dated 26.05.2016 (Annexure-3 to the writ petition) passed by the respondent no. 3 the Sub-Divisional Officer, Chatra by which the petitioner’s PDS licence has been cancelled and subsequently in appeal preferred before the respondent no. 2, the said order has been confirmed.
2. Having heard learned counsel for the parties and keeping in view that the petitioner has an efficacious remedy of preferring second appeal before the Commissioner, North Chhotanagpur Division, Hazaribagh under Rule 30(i) of Jharkhand Targeted Public Distribution System (Control) Order, 2019, I am not inclined to entertain the writ petition at this stage.
3. The writ petition is accordingly dismissed as not maintainable at this stage. The petitioner is, however, at liberty to take appropriate recourse against the impugned orders as provided under law.
