ORDER :
1. The present writ petition has been filed for quashing the notice dated 13th February, 2021 (Annexure-3 to the writ petition) issued by the Circle Officer, Giridih-respondent no. 5 to the petitioner under Section 4(h) of the Bihar Land Reforms Act, 1950 (hereinafter to be referred as ‘the Act 1950’) for cancellation of Jamabandi with respect to the land appertaining to R.S. Plot No. 529, Khata No. 116, Mouja Harsingraidih, P.S. and District Giridih, measuring an area of 0.39 acre, which, according to the petitioner, has been purchased by virtue of registered sale deed dated 27th September, 2007 and his name has been mutated in the revenue records on making due enquiry as well as rent receipts are being issued by the revenue authorities in his name.
2. Having heard learned counsel for the parties and keeping in view that the petitioner has sought challenge to the notice issued under Section 4(h) of the Act, 1950, instead of entertaining the writ petition on merit, the petitioner is given liberty to file reply to the said notice putting his appearance before the respondent no. 5.
