Judgment :-

(Petition filed under Article 226 of The Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records/proceedings of the first respondent, the Film Certification Appellate Tribunal bearing proceedings No.1/5/2000-FCAT dated 16.12.2005 of the first respondent and quash the separate orders issued by the members Dr.Alka B.Vadkkan and Shri J. Narsinga Rao and consequently direct the respondents to grant certificate for the "Kutrapathrikai" in Tamil, for public exhibition as directed by the orders of the Chairperson of the first respondent Film Certification Appellate Tribunal, New Delhi and agreed to by another member of the Tribunal viz., Dr.Firoza Bano.)

The writ petition relates to the certification of a Tamil film titled "KUTRAPATHRIKAI" for public exhibition.

2. The petitioner launched the production of a Tamil feature film with the above title during July, 1991 and completed the same during December, 1992. The film basically revolves around the assassination of the former Prime Minister Shri Rajiv Gandhi. As the petitioner is required to obtain a censorship certificate for public exhibition of the film, it applied to the Chairperson
